Collision coverage for rideshare drivers and Lyft/Uber changes depending on what they were doing at the moment the accident happened. Specifically, whether the driver was “offline” (i.e., driving with their rideshare app turned off and not seeking fares) or “online” (either driving with the app on and awaiting a ride request, driving to pick up a passenger or transporting a passenger). For collisions with an Uber driver, liability breaks down as follows:

  • Driver offline: the driver is generally solely liable for any injuries they cause in a car accident. Texas law requires rideshare drivers to carry a minimum of $30,000 of coverage per injury, $60,000 in total injury coverage and $25,000 for property damage.
  • Driver online: the driver’s insurance is the primary coverage, but if your damages are higher than that policy’s limits (or the insurance company denies your claim), Uber’s Contingent Liability Coverage kicks in. For injuries suffered while the driver was en route to picking up a passenger, this supplemental insurance covers up to $50,000 per injury, $100,00 in total injuries and $25,000 in property damage. If the accident happened while a passenger was in Uber, the supplemental coverage would increase to a $1 million limit for total liability.
